Checklist - Making a Motor Accident Claim

Depending on the nature of the case, the following documents need to be submitted to the Public Trustee by/through your lawyer:

Out of Court Settlement

  • Motor Accident Compensation Settlement (The eService is available at IPTOOnline Portal )
  • Traffic Accident Report(s) lodged with the Police;
  • Sketch Plan of the scene of accident (if any);
  • Medical and Specialised Report(s);
  • Coroner's notes of evidence and autopsy report in fatal cases (if any);
  • Grant of Probate/Letters of Administration (if any); and
  • Case authorities supporting the settlement involving unusual or multiple injuries.

Court Settlement

  • Annexure A;
  • Judgement or Order of Court; and
  • Grant of Probate/Letters of Administration (if any)

Your lawyer will also need to submit his proposal for his legal costs (known as 'Solicitor & Client's Costs') to the Public Trustee for his recommendations in Annexure C.
